Terms of Use

These terms govern your use of Nuri's Nest ("the app"), made by Fatih Ünal, trading as Poyralgo ("we", "us"). By downloading or using the app you agree to them. If you do not agree, please do not use the app.

1. What we give you

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your family's own non-commercial use. This licence does not transfer ownership of anything to you.

2. What you agree not to do

• Copy, sell, rent, sub-licence, or redistribute the app or its contents.
• Reverse engineer, decompile, or disassemble the app, except where law permits it.
• Remove or obscure any notice of copyright, trade mark, or ownership.
• Use the app in any way that breaks the law, or attempt to interfere with its operation.

3. Ownership

The app, its illustrations, the character Nuri, its text, sounds, design and code belong to us or to our licensors, and are protected by copyright and other laws. Everything not expressly granted to you in these terms is reserved.

4. Privacy

The app collects no personal data and makes no network requests. Our Privacy Policy explains this in full and forms part of these terms.

5. Educational content

Nuri's Nest is a toy and a teaching aid, not a clinical, diagnostic, or assessment tool. Translations and pronunciations are prepared carefully, but language varies by region, dialect, and household, and a word taught here may not be the word your family uses. The app does not measure ability and must not be relied on to judge a child's development. If you have concerns about your child's speech, language, or hearing, please speak to a qualified professional.

6. Screen time and supervision

The app offers a daily goal, an optional daily limit, and a bedtime wind-down. These are aids, not safeguards: they do not replace an adult's judgement about how long a young child should spend on a screen, and you remain responsible for supervising your child's use of the device.

7. Purchases

The app contains no purchases at the time of writing. Should an optional paid plan be added, it would be sold and administered by Apple through the App Store; payment, renewal, and refunds would be governed by your agreement with Apple, and refund requests would need to be made to Apple rather than to us.

8. Changes to the app

We may update, change, or withdraw the app or any of its features at any time. We will not deliberately remove a feature your family relies on without good reason, but we cannot promise that any particular feature, language, or category will remain available indefinitely.

9. No warranty

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including as to merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted or free of errors.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the app. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Nothing in these terms affects the statutory rights of a consumer, which vary by country and cannot be excluded.

11. Termination

This licence ends if you stop using the app or delete it, or if you break these terms. On termination you must stop using the app and remove it from your devices.

12. Apple

These terms are between you and us, not between you and Apple, and Apple is not responsible for the app or its contents. Apple has no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, save that if you are a consumer resident elsewhere you keep the benefit of any mandatory protections and the right to bring proceedings in the courts of your own country.

14. Changes to these terms

If these terms change, the effective date above will change with it. Continuing to use the app after a change means you accept the revised terms.
